Erstaunliche Wissenslücken bei Richtern und Justizpersonal
Oft wissen auch Richter bzw. die Justiz- und Standesbeamten nicht ausreichend über die existierenden Gesetze Bescheid. So haben Frauen nach islamischem Recht die Möglichkeit, das volle Scheidungsrecht, das Recht auf Berufstätigkeit und komplette Bewegungsfreiheit in ihren Ehevertrag hineinzuschreiben.
Die sogenannte „Esma" wird allerdings in arabischen Ländern so gut wie nie in Anspruch genommen. Entscheidet sich eine Frau doch dafür, muss sie gegen die Ignoranz oder den Unwillen der zuständigen Justizbeamten oder Richter ankämpfen.
Als die jordanische Entwicklungsexpertin Muna Salameh (35) die Esma in ihren Ehevertrag schreiben lassen wollte, blickte sie in das verdutzte Gesicht des Standesbeamten. „Mein Mann und ich wollten den Vertrag auf jeden Fall in dieser Form abschließen, mit gleichen Rechten für beide Partner in allen Belangen. Doch der Beamte hatte solch einen Ehevertrag noch nie gesehen. Er glaubte einfach nicht, dass das jordanische Gesetz diese Form des Ehevertrags zuließ!“ Erst als ein Rechtsanwalt das offizielle Gesetzbuch und den entsprechenden Paragraphen präsentierte, lenkte der Beamte ein.
